33rd Judicial Circuit Implements Family Court



Beginning January 1, 2017, there shall be established in the 33rd Judicial Circuit, consisting of both Scott and Mississippi Counties, a Family Court. (Section 487.010)

Division II in Mississippi County and Division IV in Scott County shall be designated as the Family Court Division in each county.  The Honorable Rob Barker, is designated as Administrative Judge in the Family Court for an initial term of two years beginning on January 1, 2017.

The jurisdiction of the Family Court shall consist of the following cases and case type. (Section 487.080)  Chapter 452 - Domestic Relations; Chapter 453 - Adoption; Chapter 211 - Juvenile; Chapter 210 - Child Protection; Chapter 454 - Support Enforcement; Chapter 455 - Adult Abuse and Child Protection Order; Annulments, Change of Name and marriage license waiting period waivers.

There is established in the treasury of Scott County a "Family Services and Justice Fund" (Section 488.230).

In each county the Circuit Clerk shall charge and collect a surcharge of $30.00 in all proceedings falling within the jurisdiction of the Family Court.  The surcharge shall not be charged when no court costs are otherwise required, shall not be charged against the Petitioner for actions filed pursuant to the provisions of Chapter 455 but may be charged to the Respondent in such actions, shall not be charged to a government agency and shall not be charged in any proceedings where the costs are waived or are to be paid by the state, county or municipality.

In Juvenile proceedings under Section 211 a judgment of up to $30.00 may be assessed against the child, parent or custodian of the child, in addition to other amounts authorized by law, in informal adjustments made under the provisions of Section 211.081 and 211.083 and in order of disposition or treatment under the provisions of Section 211.181.  The judgment may be ordered paid to the Clerk of the Circuit where the assessment is imposed.

The Court En Banc shall meet annually to determine the assessment in Chapter 211 cases.  For 2017 the assessment for Juvenile cases shall be $30.00.

Honorable Rob Barker shall remain as presiding Juvenile Judge for the 33rd Circuit and any disqualification or recusal by him in Juvenile Court cases shall be assigned to the Judge of Division IV in Scott County, being the other Family Court Judge.

If you are considering representing yourself in a Missouri family court matter, this alert is being released to simply make you, as a court user, aware of a potential concern. Please follow up with your own research and make your own decisions. Clerks are NOT allowed to give legal advice and this announcement should not be taken as such.

In 2008, the Supreme Court of Missouri created the Committee on Access to Family Courts (CAFC). Since its inception, CAFC members have worked diligently to insure access to justice in family courts throughout Missouri by drafting and approving statewide forms, educational materials, a self-help test, and much more, all in an effort to help individuals self-represent in certain family/domestic court matters.

Recently circuit clerks, across the State of Missouri, have seen an increase of pro se filers who claim to have paid a third party company, typically an online company, considerable sums of money, for the same, or ever so slightly altered versions of the same, documents currently available through the State's website free of charge.

Per local court rule, Pro Se filers must use the official CAFC created, and Supreme Court approved, forms in Scott County.   Unapproved forms often result in delayed cases and have, upon occasion, even resulted in the dismissal of newly filed cases.  If that's not enough to concern you, consider this, the filing fees cannot be refunded just because a case is dismissed.

Please do your homework before purchasing online family court forms.  To better serve you, please check out the link below to see if information is available for your situation.  As always, if you are unsure, seek the advice of legal counsel for direction and assistance.

Pasport applications will not be accepted after 4:15 P.M. daily.

Due to end of the month financial processing, we are unable to accept passport applications after 3:00 PM on the last working day of the month. We apologize for the inconvenience.

Effective January 5, 2015, we can no longer accept payments made payable to the Scott County Circuit Clerk's Office for U.S. Department of State passport application fees. This includes credit card payments. Payment method must be made directly to the U.S. Department of State. (Each passport application must have one payment in the form of check, money order,credit/debit card or cash, payable to the Scott County Circuit Clerk,and a second payment to the U.S. Department of State, which must be a check or moneyorder.)  Exceptions CANNOT be made to this policy.

Standard process fees are: Adults ages 16 and over $135.00; Children under age 16 $105.00. Additional fees apply for expedited service.  The following are generally required items to apply for a 1st time issued Passport:  Fees, as listed above; Birth Certificate, which must contain a raised seal; valid drivers license or other form of acceptable ID; passport photo; completed application.  Our office does not take passport photos.
